These Terms of Service (“Terms”) govern your access to and use of the Quiosque25 website and service (the “Service”), provided by Quiosque25, located at R. da Corticeira da Serra, 110 — Cachoeira do Bom Jesus, Florianópolis — SC, 88056-368, Brazil (“Quiosque25”, “we”, “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Quiosque25 is a software service that analyzes user-uploaded audio recordings and automatically detects the musical genre, subgenre, mood, tempo (BPM) and key, and provides related export and API access features. Analysis results are informational and are generated by machine learning algorithms; we do not guarantee absolute accuracy.

2. Account

• An account is required to use paid features.
• You must provide accurate information and keep it up to date.
• You are responsible for keeping your credentials secure and for all activity under your account.
• You must be of legal age or use the Service with the consent of a legal guardian.

3. Subscription and payment

• The Service is offered on a subscription basis on the Starter ($2/month) and Pro ($5/month) plans.
• Subscriptions renew automatically each billing period until cancelled.
• Payment, invoicing and collection of applicable taxes are handled by Paddle.
• You may cancel anytime; access remains until the end of the paid period.

4. Refunds

Our Refund Policy applies to the Service and includes a 30-day money-back guarantee. By making a purchase, you confirm that you have read and accept it.

5. Acceptable use

You agree not to use the Service to:

• upload content for which you do not hold the rights or necessary licenses;
• infringe the copyright or related rights of third parties;
• attempt to bypass restrictions, reverse-engineer or interfere with the Service;
• access the Service in an automated way beyond your plan limits or outside the API;
• engage in any unlawful activity or violation of applicable law.

6. User content

You retain all rights to the audio files you upload. You grant us a limited license to process your files solely for the purpose of providing the Service. We do not use your audio to train models and we delete it after processing, as described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, trademarks and models, belongs to Quiosque25 and is protected by intellectual property laws. These Terms grant you no rights other than a limited right to use the Service.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all express or implied warranties, including warranties of analysis accuracy, fitness for a particular purpose, and uninterrupted operation.

9. Limitation of liability

To the maximum extent permitted by law, Quiosque25 is not liable for indirect, incidental or consequential damages. Total liability for any claim shall not exceed the amount you paid for the Service in the preceding twelve (12) months.

10. Suspension and termination

We may suspend or terminate access to the Service in the event of a breach of these Terms. You may stop using the Service at any time by cancelling your subscription.

11. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after the changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules.
